Recently, Eric Rossman of Rossman Law Group acted as the lead foster care attorney in the extraordinary case of the Mueller family vs. the County of San Bernardino. The Muellers were foster parents on the path to adoption of two brothers who had been in the system for several years after being removed from their abusive biological parents. While living with the Muellers, the older boy physically and sexually abused his younger brother. After adoption, the younger brother began disclosing the sexual abuse to his new parents and the older brother became very hostile and started threatening the mother.

An investigation revealed that the county’s foster care system was aware of these behavioral patterns—and that the older brother had been sexually abusing his brother and other foster children for years in previous homes. Despite the alarming nature of these actions, the brothers continued to be placed in foster homes together. The younger brother said he had told his social worker about the abuse he continuously suffered and the social worker told him to keep it a secret or he wouldn’t be adopted.

Rossman assisted the Mueller family in filing a lawsuit against San Bernardino County, citing their foster system’s knowledge of the older brother’s abusive actions and failure to protect the younger brother from harm. In September of 2022, San Bernardino County settled with the Mueller family and agreed to pay $7.5 million in damages.
